General Information

The European Data Protection Supervisor (EDPS) is an authority established on the basis of Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data.

The current framework of the functioning of the EDPS is regulated by Regulation (EU) 2018/1725 of the European Parliament and of the Council of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC (hereinafter referred to as the “Regulation”).

The EDPS shall be responsible for:

  • ensuring that the fundamental rights and freedoms of natural persons, and in particular their right to data protection, are respected by Union institutions and bodies with respect to the processing of personal data;
  • monitoring and ensuring the application of the provisions of this Regulation and of any other Union act relating to the protection of the fundamental rights and freedoms of natural persons with regard to the processing of personal data by a Union institution or body;
  • advising Union institutions and bodies and data subjects on all matters concerning the processing of personal data.

The European Parliament and the Council appoint by common accord the EDPS for a term of five years, on the basis of a list drawn up by the Commission following a public call for candidates. The European Data Protection Supervisor can be reappointed once.

The EDPS shall act with complete independence in performing his or her tasks and exercising his or her powers in accordance with this Regulation; shall remain free from external influence, whether direct or indirect, and shall neither seek nor take instructions from anybody; shall refrain from any action incompatible with his or her duties and shall not, during his or her term of office, engage in any other occupation, whether gainful or not.
